General Terms and Conditions of Use of We Buy Your Tickets (Last updated 6 October 2023)
We Buy Your Tickets is an online service for the purchase of tickets at the Internet address www.webuyyourtickets.com and other domain extensions (hereinafter referred to as: Service). In particular, the Service allows users to offer for sale tickets for events in the areas of sports, concerts, entertainment, theatre, and musicals (hereinafter referred to as: Events). These terms will also apply if there is specified a different legal entity offering the services (I.e., a We Buy Your Tickets subsidiary) for specific countries (domains), Events or Listings.
Your use of the Service (including access via smartphones and mobile phones) will be governed exclusively by the following General Terms and Conditions of Use (hereinafter collectively referred to as: Terms of Use). The Terms of Use shall apply between users (sellers and/or buyers) and We Buy Your Tickets By using this Service, you consent to the applicability of these Terms of Use.
Our Terms of Use are divided into three different subsections:

The following terms apply to all users of the Service, hereinafter collectively referred to as “Users“.
Sec. 1: Eligibility/Registration
In order to be eligible for participation in the Platform, it is necessary to complete the prescribed registration process including the correct provision of all requested information on the respective registration form. Registration is free of charge except for any telecommunication costs which may occur.
Only persons aged 18 and over with unlimited legal capacity as well as legal entities are entitled to use this Service.
Users are obliged to provide correct and complete information during the transaction process. Users must not pretend to be a different person, use a name which they are not entitled to use or infringe third party rights in any other way in the context of the registration process.
If incorrect information is provided, Users may be permanently or temporarily excluded from using the Service, also upon expiry of a deadline where required.
With each use of the Service, the Users undertake to comply with the rules stipulated in these Terms of Use. A non-compliance with the Terms of Use may lead to a temporary or complete exclusion from the Service.
Sec. 2: We Buy Your Tickets’ Role
Please note that We Buy Your Tickets merely provides a service to purchase tickets for Events and neither hosts Events or sells tickets.
Sec. 3: Principles of Service Use
Users are not permitted to carry out advertising (including self-advertising and links) on the We Buy Your Tickets website.
Insofar as We Buy Your Tickets has not granted its express consent, the Users undertake not to use any data which is accessible on the website or has come to their knowledge due to the use of the Service in any way unless the data use serves the purpose of performing the contract. It is not permitted to use such information and data for advertising, unsolicited emails, other unwanted communications or for other purposes which go beyond the purpose which serves the Service.
Sec. 4: Data Protection, Consent for Advertising Purposes
We Buy Your Tickets has comprehensively informed the Users about the type, extent, place and purpose of the collection, processing and use by We Buy Your Tickets of the personal data required for the registration for the Service (see Privacy Policy).
Within the framework of their registration on the website, the Users have the option to consent to the receipt of newsletters regarding current trends, developments and offers of We Buy Your Tickets. Such consent may be withdrawn vis-à-vis We Buy Your Tickets at any time with effect for the future.
Sec. 5: Term, Termination, Exclusion of Users
The contractual relationship between We Buy Your Tickets and the User commences upon registration on the website or use of the Service.
The user relationship is unlimited in time and can be terminated by either party to take effect at the end of the calendar month at any time in written form observing a notice period of one month.
In case of a breach of these Terms of Use, of statutory provisions or of third-party rights, We Buy Your Tickets shall be entitled to take adequate steps to end the breach or to remove its consequences, such as to immediately block individual content or Users (temporarily or permanently). Such measures may also take the form of warnings, suspensions of use or termination of the participation in the Service and/or denial of access to the Service. The respective User’s legitimate interests, in particular whether and to which extent the User is responsible for the breach, will be fully taken into account by We Buy Your Tickets.
Sec. 6: No Guarantee of the Platform’s Correctness and Availability
We Buy Your Tickets does not make any guarantee that the Service will always be available.
Sec. 7: Liability
Claims of the Users against We Buy Your Tickets for damages shall be excluded. This shall not apply to claims of the Users for damages resulting from injury to life, body or health or resulting from an infringement of material contractual obligations (cardinal duties) as well as claims for other damage resulting from the violation of an obligation caused by intent or gross negligence of We Buy Your Tickets, its legal representatives or vicarious agents. Material contractual obligations in this sense are such obligations whose performance is necessary to achieve the objective of the contract.
In case a material contractual obligation is violated, We Buy Your Tickets shall be liable only for the foreseeable damage that might typically occur under the contract if it was caused by simple negligence, unless the User claims damages arising out of injury to life, body, or health.
The restrictions of paragraphs 1 and 2 shall also apply in favour of the legal representatives and vicarious agents of We Buy Your Tickets if claims are asserted directly against them.
Sec. 8: Indemnification Clause
The Users shall indemnify We Buy Your Tickets against any claims asserted by other Users or other third parties against We Buy Your Tickets regarding infringements of their rights with respect to the tickets sold using the Service and other content posted on the website.
Sec. 9: Final Provisions
The relationship between We Buy Your Tickets and the Users shall be governed by UK law, unless otherwise is specified.
If any provision of these Terms of Use or a provision within the framework of any other agreement is or becomes invalid, this shall not affect the validity of the other provisions or agreements.
We Buy Your Tickets is neither obliged nor prepared to participate in any dispute resolution proceedings before a consumer conciliation board.
The user is obliged to not disclose or publish statements, information on transactions, information on claims, or information on disputes that might harm the reputation of We Buy Your Tickets in any way. This includes defamatory statements, untrue and/or incorrect statements or information. We Buy Your Tickets may unilaterally decide penalties for spreading such information, or false or incorrect statements, and withhold this from any outstanding payments due, until resolved or removed. We Buy Your Tickets may also ask for a signed undertaking that such statements or information shall not be published or spread to others in the future before releasing withheld funds.
